Fed. Circ. Orders Interest Recalculation In Hardware IP Row

For nearly two decades, Pulse Electronics has been navigating a complex legal landscape in its longstanding patent dispute with Halo Electronics. Recently, the Federal Circuit has affirmed the district court’s denial of enhanced damages and attorney fees sought by Halo, as well as Halo’s efforts for a new damages trial.  The Court further mandated a recalculation of the prejudgment interest initially awarded to Halo in 2023, citing the interest should be determined based on a shorter time period than was initially calculated.

West Allen, who represents Pulse, confirmed with Andrew Karpan of Law360 that a principal issue remaining in this case over the last many years is a determination for how long a case may be closed and yet still enable plaintiffs’ counsel to pursue further monetary gain against new corporate owners.

“We believe this decision will help bring some clarity and resolution to that question. Justice requires this matter to be closed.”
