Maria is an experienced employee benefits attorney who advises clients on the many requirements of the Employee Retirement Income Security Act (ERISA), the Internal Revenue Code (including 409A and 401(k)), the Health Insurance Portability and Accountability Act (HIPAA), the Patient Protection and Affordable Care Act (PPACA), and the various laws regulating defined benefit pension plans (both single employer and multiemployer). Maria drafts and provides guidance on executive compensation plans, including stock options, restricted stock, phantom equity and stock appreciation rights. Maria handles the benefit plan transition process during mergers and acquisitions, including plan mergers and plan terminations. Maria is well-versed in drafting and providing regulatory guidance for health plans, 401(k) plans and defined benefit pension plans (including withdrawal liability matters). Maria advises clients on impermissible benefit changes, as well as ensuring all required documentation is dispersed and filed as required by law. Maria is also well versed in drafting plan and trust documents, summary plan descriptions, plan notices and other participant communications.
