Howard & Howard Wins Unprecedented Appeal in Nationally Watched Landmark Case (Thursday, October 24, 2013)

In a nationally watched appeal challenging the Chicago Landmarks Ordinance, we obtained reversal of the trial court’s order dismissing 16 counts of Plaintiffs’ complaint. The decision will allow our clients to pursue unprecedented claims against the City of Chicago that it arbitrarily, capriciously, and discriminatorily applied the Landmarks Ordinance in creating two landmark districts in which they own property. The gravamen of Plaintiffs’ claims is that the arbitrary application of the Landmarks Ordinance harms property values, property owners, businesses, and real estate development, while demeaning legitimate historic preservation efforts.
