Mr. O’Malley concentrates his practice in commercial litigation and appellate law.

He is driven to conduct exhaustive research that informs his thinking and legal writing. Armed with that knowledge, he is prepared to break down complex and novel legal issues in order to develop creative solutions on behalf of his clients. Mr. O’Malley has briefed issues for the Nevada Supreme Court in high-profile matters including class certification, federal preemption, arbitrability, and First Amendment law. He has also litigated state and federal cases at the district court level ranging from medical malpractice, banking, breach of contract, collections, class action suits, fraud, fraudulent transfers, injunctive relief, leases, commercial real estate, unlawful detainer, and writs of mandamus/prohibition.

Mr. O’Malley is a Las Vegas native, and received his B.S.B.A. in Finance from UNLV in 2007. He received his J.D., magna cum laude, from Washington University School of Law in 2011, graduating in the top 3% of his class. During law school, he served as a senior editor of the Washington University Law Review, and as a judicial extern to the Honorable Robert C. Jones at the U.S. District Court for the District of Nevada. Mr. O’Malley is licensed to practice in the State of Nevada.

  • Representative Matters

    • Represented a school district in an election law case in which a political think tank attempted to remove a ballot initiative from voter consideration based upon an alleged technical violation of Nevada’s open meeting law. The think tank’s motion for preliminary injunction was denied, the Nevada Supreme Court affirmed in an expedited appellate review, and the case was subsequently dismissed.
    • Represented an insurer in Nevada Supreme Court proceeding involving an insurance coverage/bad faith dispute where the judgment after trial exceeded $10 million. The Nevada Supreme Court ultimately reversed and remanded for a new trial.
