Mr. Wittebort concentrates his practice in the areas of corporate transactions, mergers and acquisitions, transportation and logistics, commercial lending, creditors' rights, and various types of real estate transactions.
Mr. Wittebort represents privately-held companies, publicly-held companies, and municipalities in various facets of acquisition, disposition, development, and leasing of both real and personal property. He has extensive experience in advising real estate developers regarding residential and business condominiums, retail and mixed-use projects, including land use, planning, retail leasing, development issues and various governmental incentives. He also has particular experience in representing both Downtown Development Authorities and developers in downtown redevelopment projects involving tax increment financing and other similar types of tax incentives.
Mr. Wittebort represents a number of manufacturers, including automotive suppliers, and is familiar with various organizational and structural issues including supply agreements, Terms & Conditions and various applicable UCC issues. He also represents a number of clients involved in the transportation and logistics industry.
Mr. Wittebort has broad experience in various types of financing, including both asset based and real estate credit facilities. He represents a number of lenders with respect to loan origination, creditors’ rights and various types of loan workouts.
In 2008, Mr. Wittebort was appointed by former Michigan Governor Jennifer Granholm to be a member of the Financial Review Team formed to oversee and assist the City of Pontiac, Michigan with its financial deficit problems and has often been requested to advise on similar issues involving Michigan’s Emergency Manager law for governmental entities.
Mr. Wittebort is a frequent author and lecturer on a variety of business and professional topics including downtown redevelopment and real estate and asset-based financing, including tax increment financing and other public incentive programs. He has been named to Michigan Super Lawyers® for years 2008 - 2017, as well as the May/June 2009 issue of Super Lawyers – Corporate Counsel Edition for real estate. Mr. Wittebort has also been recognized in DBusiness – Top Lawyers in Metro Detroit. He has appeared in numerous publications and radio and television news programs regarding Michigan’s Emergency Manager law and the City of Detroit Bankruptcy and reorganization efforts.
Mr. Wittebort is active in multiple community and charitable organizations including the Pontiac Neighborhood Revitalization Corporation and the Oakland County Mainstreet Advisory Committee. He also serves as the Chairman of the Howard & Howard Community Reinvestment Fund; an employee-funded, donor-advised trust that has donated over $4 million to various charitable organizations since its inception in 1985.
Mr. Wittebort received his B.S. from Western Michigan University in 1985 and his J.D. from Wayne State University Law School in 1988, where he was an Assistant Editor of the Wayne Law Review and participated in Moot Court. He is a member of the Oakland County Bar Association, American Bar Association, the International Council of Shopping Centers, and the Transportation Lawyers Association. Mr. Wittebort is licensed to practice law in Michigan.
